BLEACHERS BREW EST. MAY 2006

Someone asked me how my blog and newspaper column came to be titled "Bleachers Brew". It's like this, it's an amalgam of sorts of two things: The bleachers area in the stadium/arena where I used to sit when I would watch baseball, football, and basketball games and Miles Davis' great jazz album Bitches Brew. That's how it got culled together. I originally planned on calling it "The View from the Big Chair" that is a nod to Tears For Fear's second album, Songs from the Big Chair. So there.

Ateneo to ask UAAP to look into "violations" of suspended players

Dear Fr. Rendon:

It has been brought to our attention that University of the East (UE) player Ralf Olivares was seen seated behind the UE bench at the Mall of Asia Arena yesterday, 8th September 2013, during the men’s basketball game between the Ateneo de Manila Blue Eagles and the UE Red Warriors.

Given that Ralf Olivares had been issued a one-game suspension by the UAAP 76 Commissioner Chito Loyzaga, a suspension that he was supposed to serve yesterday, his presence behind the UE bench during yesterday’s game time is a violation of UAAP 76 Rules and Regulations, which under “Sanctions” says:

“a suspended athlete shall not be allowed to sit in the bench and its immediate vicinity during the period of suspension. A violation of the condition of the suspension shall result in the forfeiture of the game where such suspended athlete was found present”.

In view of this, the Ateneo de Manila University (AdMU) respectfully requests that the UAAP 76 Board conduct an investigation of this matter and that the appropriate sanctions be imposed in accordance with the UAAP 76 Rules and Regulations.

In addition to the foregoing incident, we would like to seek clarification as well on the following games, among others, where suspended players were likewise seen in the immediate vicinity at times when they should have been serving a suspension:

·               25th August 2013, UAAP 76, Match #40 between UE and Far Eastern University (FEU) where RR Garcia was seen in the immediate vicinity of the FEU bench;

·               31st August 2013, UAAP 76, Match #44 between UE and National University (NU) where Charles Mammie and Lord Casajeros were seen in the immediate vicinity of the UE bench;

·               1st September 2013, UAAP Season 76, Match #46 between AdMU and De La Salle University where Thomas Torres was seen sitting on the DLSU bench and the immediate vicinity of the bench

·               4th September 2013, UAAP Season 76, Match #48 between UE and DLSU where Lord Casajeros was seen in the immediate vicinity of the UE bench.

Please also look into similar violations in games of the Juniors’ and Women’s Basketball Divisions.

We thank you for this opportunity to be heard and are hopeful for an outcome that would ultimately be favorable to the UAAP and its ideals.

    3. Gunggong!! Iba ang rule sa coaches/official sa athlete. Ang athlete, bawal lang sa bench pero ang coach, bawal mismo sa venue!! At kahit sabihin natin may mali.. e hindi kayo nagprotesta agad within the 24 hour period!! Malas niyo lang.. nagprotesta UE within 24 hourd. And coach Bo, being inside the dugout, is a clear violation of the rule!!

    4. You can site all those instances where suspended players are at the venue but the thing is the 24 hour rule does apply. If wala naman nagprotesta during those games hindi naman take into action ng Uaap Board yan. Nagkataon nagprotesta ang UE so the UAAP Board should stick to their rule book. Does it even say in the rule book that UAAP Board members can amend that rule?

    9. Please, put the rule that says, teams are only given 24 hours to file a protest. I'm not sure if there are any precedents, but so far, there is none that says that. Otherwise, Mr. Ricky Palou would have known, thus not prompting him to file a letter. He wouldn't submit a letter if he had known that there is a rule that says teams can only file a protest within 24 hours.

  3. Medyo malabo talaga yung "immediate vicinity" ng UAAP. Pwedeng sabihin na nasa Patron si Olivares at wala naman sa ringside. Pero wala namang mafoforfeit na win ang UE kasi talo naman sila sa game kung saan nakita si Olivares, unless gagawing win ang talo ng UE vs Ateneo for that game. Pero sa kaso ng Ateneo, malinaw na bawal sa venue si Perasol. Dapat wala talaga siya doon. Ang hindi ko magets ay kung paano nabigyan si Perasol ng go signal na makapunta sa game kahit nasa rules naman na dapat wala siya sa venue. Palakasan?! Oo wala siya sa bench, pero nasa dug out daw siya. Mahirap tuloy sabihin na hindi naman siya nagcoach sa game na iyon.

    1. The rules say forfeiture of the game, not forfeiture of the win. Win or lose, a violation warrants forfeiture.

      Also, I can't recall this properly, but wasn't Olivares' seat near the bench? Patron nga pero nasa likod lang rin naman ng bench ng UE. "Immediate vicinity" rin yun, assuming my memory of his seat is correct.

      What about Thomas Torres? Same case with Olivares, but this time he even went to the court to cheer with his team after the game. Wag mong sabihin hindi yun violation?

      -> Meron naman cellphone, skype, chat, etc. Kahit nasa bahay yung tao, pwedeng-pwedeng magcoach or contact indirectly. So parang wala talagang point kung nasa lugar or hindi yung coach sa case na ito. Ano, kinausap lang niya yung players biglang lumakas shooting nila? Coaching is a strategic ACTIVE job that requires decisions on the fly. So a pep talk in the locker room is not a factor to the win as it was to having other suspended players behind the bench. Then again lahat may mali at lahat desperado na haha

  6. Everybody is guilty, no doubt, but Mr. Palou's complaint will only make matters worse as it is obviously in retaliation to the earlier action taken by UE. There's really no genuine concern for the faithful adherence to the rules and even simpletons will not be fooled into thinking otherwise. He should, at all times, remember that he represents a community with more sophistication and it is imperative that he acts accordingly!

      an alleged letter written by u.e., confirmed by the officials but actually doesn't have an/any evidence of this said complaint letter then 24hrs hasn't been expired after this news ADMU filed a counter complain which made public of the same grounds...Y?

    You need to LEARN the rules...pay particular attention to the 24-hour prescription period. You made a BIG mistake, man-up!

    You look like a drowning man trying to take down with you anyone within arm's length when the bigger man would be saving them.

    Fr. Jett, pls. step in and end this madness. The honorable thing to do is to admit it If DLSU was able to admit their mistake, return a basketball championship trophy and survive a one-year ban on all sports(unjustified if I may say so), all the more an admission is expected from ADMU. It's the Lux in Domino thing!

  10. AGREE^ UAAP must look at spirit of the rule. If Bo merely watched at venue then no issue. If he talked/coached the team at the half then it becomes a different story. According reports before he went to the court to congratulate Coach sandy he stayed at the locker room the whole time.I would assume nag coach siya nung halftime? I mean ano gagawin niya dun diba? Pag player ka ok lang manood the main reason is for you not to play! Basta hindi maglaro nasatisfy naman yung essence ng suspension diba?

Ang coach pag nasuspend primary reason is for them not to coach! I am a lasallian and i would love for ateneo and lasalle to be in the finals (no offense to the other schools lol) but it annoys me to no end when ateneans who repost this act as if they just played an awesome hand to bring down everyone else. It's like saying "hey the players (who, lets just put things in perspective, are mostly kids, theyre students) have been violating the rules so why cant our coach do the same?" Im not saying being a student makes it an excuse to break the rules. It's not. Everyone must respect the rules. In this case being a player and sitting in the patron section and not playing is different from being a coach and sitting in the dugout and lol what? Not coaching? I mean come on. In my opinion, bo perasol has caused too much ruckus already for ateneo.

    2. Oh im not defending the players who might have violated the said rule. But "immediate vicinity" is rather subjective. Sitting in the patron section might count as being outside "immediate vicinity" coz the term is so contestable vs say 10m from the bench. If they violated the rule, and the board sees it fit to forfeit the games then i respect that. I just dont think it was a good move by ateneo.

  16. Tama may yung hunirit dito ng procedural (remedial) at substantive justice, but I want to point out na:
    1. On the substantive side, walang locus standi yung Ateneo para UE-NU, UE-FEU, at UE-DLSU games. Hindi kayo involved dun, so walang karapatan nyo na-violate. You can only protest things directly done to you. This is a substantive right, the right to sue, unfortunately you cannot invoke somebody else's right in your favor; and
    2. On the procedural side, assuming without conceding that Ateneo does have locus standdi, the complaint still cannot be given due course because it was filed out of time and, in any event, Ateneo is estopped by laches. The protest period is clear: 24 hours. All of these complaints are beyond the reglementary period. Fault ng Ateneo yan na hindi kayo naging vigilant, at merit ng UE yan na sila vigilant enough to protest on time. Also, may laches na dito: Ateneo's failur to protest immediately, in law, means they are waiving their right to do so, if any.

    Sorry. It sucks that Ateneo has to go through this controversy. If they indeed asked for permission from the UAAP for Coach Bo, dapat sana in writing, parang incontrovertible. And, wala ng sense na iaangal nila yung sa iba ngayon, kasi ang mali ng iba ay never mag-e-excuse ng mali nila. Hindi naman to selective prosecution, kasi noon, wala naman umangal nung may panahon pang umangal. Malas lang Ateneo na yung UE, in-exercise nila yung pagkakataon nilang umangal within the period allowed.

    1. Bakit laging panig sa Ateneo kamo? Eh sino ba ang broadcaster ABS-CBN diba. Yung mga boss ng ABS-CBN nakikita mo naman sa games, naka blue at cheering for Ateneo. Si Montinola eh Atenista din, kaya nga ang FEU ay parang sister team.

      Dami pa kasing Moro-Moro para sa trophy. Haaaay pati basketball parang politika ng bansa. Sa bagay puro Atenista kasi ang nagpapatakbo.

  20. If decisions turn out to be in favor of ateneo. Alam na talaga. I guess it should be better for all other teams to just boycott and leave ateneo alone together with the commissioner and suck that championship up na kinababaliwan nila. After all the uaap board will do all just to pave way to ateneo!

  21. Kung ipinasa ng Ateneo ang petition after 4 pm of September 9,2013 eh hindi talaga pasok yung sa 24-hour petition. However, if they passed the petition early in the morning of September 9,2013 eh pasok yun sa 24-hour period nila kasi ang game between UE and ADMU is September 8,2013 at 2 pm nagstart yung game.

  24. The 24 hour rule is irrelevant in the case of Ateneo's letter, because it is not a formal protest. What the Ateneo is doing is raising a question about the general laxity in the interpretation and implementation of the rule on suspensions during the whole season, and possibly even in previous seasons. So this is not an issue of legal technicalities anymore, but of fairness, because if the board were to apply the rule strictly in this case, it should apply it across all cases where the same violation occurred. Otherwise, only one school is being targeted.

    Decide the championship in the hardcourt, not in the boardroom!

    1. Do you think it would be "fair" if the other games stated in the ateneo clarification letter will be forfeited as well? Well at least put your self in the shoes of the other teams involved. The problem with invoking concepts such as fairness and justice is that these two are often abstract and intangible concepts. As much as one would not want to use legal technicalities, such exist for a reason. Most of the time applying the rules strictly would cause more injustice than justice.

    4. The problem is one of arbitrariness and selectivity if the rule is suddenly implemented strictly in the case of Bo and not with the other violations (including that of Olivares in the very same game).

      That is why the Ateneo letter is meant to put some sense into the issue. Do you really want this decided by technicalities in the boardroom rather than in the basketball court? Actually someone has done the math, and if the rule on suspensions and sanctions were to be implemented strictly, Ateneo would emerge as no. 1 in the standings (see hoopnut.com). He he. Is that what UE (and other instigators of this "clarification") really want?

  26. Hindi isyu rito yung 24-hour protest rule. Parang isyu yan ng eligibility. Wala namang 24-hour rule doon. Kung madiskubre na nagpalaro ka ng player na wala naman palang high school diploma, forfeit lahat yung laro na nandun yung players na yun, pati championship, kung mapatunayang may pandaraya. Malamang suspendido ka pa.

  36. It's funny how Palou is able to muddle the issue and cause so much confusion. Coach Bo got confused and so with a lot of people.

    Stick with the real issue, not the rationalization nor the justifications. Was Coach Bo at the venue? If he was then the rule is clear. This is the only clear issue. The players issues are more for litigation, since "immediate vicinity" has to be clearly defined. What is clear to me is that venue security sit in the immediate vicinity of the bench, behind to be exact.

    1. Sino kaya itong hindi pumasa sa ACET? Very irresponsible in making general statements without even knowing the context and the gravity of the situation. And so, I will return the favor to you (and forgive me) by rebuffing you with an irresponsible comment.

      Annyway, Ateneo did not file this as a protest. Please understand Mr. Ricky Palou's letter! Ultimately, what is being questioned is not the violation of two people last Sunday but UAAP's rules and its enforcement, and that being the case, there should be no "48 hour" rule statute of limitation applied here.If the other schools have integrity as well, then they should not even consider the 48 hour rule and consider themselves guilty as well and accept as well the consequences. The problem with them is that they have no morals.
      We won the game! A hard fought battle by our Blue Eagles! then you UE will suddenly protest?? Well I believe sir Ricky got fed up and said, "Ok, so we violated a rule huh?? Look at the other teams, and UE did violate a rule too, but the bottom line is we won the game!" Because of this desperate move by UE, it takes away the credit of coach Sandy and the rest of the staff for doing a job well done, and most importantly the Blue Eagles' win. It was a hard fought battle, a win which our blue eagles dedicated to coach Bo, to the whole Ateneo community, heck we even dedicated the win to those who wanted to see us fail! And most importantly, we won in honor and as a birthday present to our Patroness, Mother Mary. Mary, for you! OBF! AMDG!

    Magkaiba ang timbang ng violation ng suspension rules sa mga sala tulad ng eligibility rules violations. Ang huli ay napakabigat kaya kahit nagtapos na ang season, nae-entertain pa ito. Hindi kawalan ng hustisya kung ang violation ng suspension rules ay may 48-hour prescriptive period lang. Mababaw lang ito. Dapat nga baguhin ang penalty. Napakabigat ng one game forfeiture. Ano ba ang napakasamang ginawa ni Coach Bo? Mala prohibita lang 'yun. Sa akin lang, puwede sana itong iapela ng Ateneo. Siyempre, kung mapatawan ng nakasaad na parusa, tanggapin na lang din ng may dangal at huwag ng gumawa ng ingay. Tutal, kahit mag 0-14 ang Blue Eagles, Ateneo is still Ateneo. Magkakandarapa parin ang mga matatalino at mayayaman na makapasok doon.

  42. What is fair since so many schools violated the rule on suspension is to let the basketball players decide the championship on the court, and not let self-interested board members do it. Violations cancel one another out. Status quo. Play on!
