QC RTC slaps TRO on UAAP re: Mikee Bartolome & the Two-Year Residency Rule

The Bartolome family was successful in securing a temporary restraining order against the UAAP and UST when Judge Manuel B Sta. Cruz granted the Temporary Restraining Order that will allow her to compete for UP in two weeks' time for the swimming competition.

The next point the lawyers will fight over is the striking off of the Two-Year Residency Rule and the One-Year Residency Rule forever.

  1. what will happen after the 20 day period? the rule is imposed again? won't that affect the status of ms. bartolome?

  2. I'm not sure if UAAP and Cesafi swimming competitions are the same, but here, it only lasts a weekend. So, if the competition is in two weeks, and the TRO is good for 20 days, that means she's safe for this season.

This is a great decision and I'm looking forward to the next court date.

  3. By its nature, its "Temporary". I'm curious too when the TRO of the UPIS guy lapses? I think it already did. What happens now? All games he played in, forfeited?

The next phase, point is more significant, which I'm presuming is the subject of Sen Pia's case filed against UAAP (or did she?). Striking the residency rule out forever, most ideal. Reducing it back to Soc Rivera, fine. Either way, the resolution must be permanent in nature and not just like this. But grats nonetheless.

  5. I think so. If this prospers into something permanent.

Kung gagarapalin ng mga aggrieved parties eh pwede din sila (lahat ng na-apektuhan ng soc rivera rule, current and past) mag-sue (pati si Soc mismo) for abuse of authority and indiscretion by UAAP resulting in loss of career in (put your sport here) and income, and causing mental anguish and loss of interest in academics. lol Who would think such a seemingly innocuous rule made as a knee-jerk reaction by a school's (singular yeah, including Pinggoy Rule) losing their star hs athlete to another uni, caused a lot of devastated spirit and destroyed career. Di marahil magbubunga sa korte, at para saan pa, except para matauhan ang Feu at board sa ginawa nila.
